U.S. Department of Labor Issues Temporary Enforcement Policy for Certifications from Crane Institute Certification

To avoid industry confusion and potential disruptions of construction crane projects, the U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) has issued an enforcement policy for crane operator certifications issued by Crane Institute Certification (CIC). OSHA requires crane operators engaged in construction activity to be certified by an entity accredited by a nationally recognized accrediting agency. CIC no longer holds such accreditation.

Massachusetts Court Sentences Contractor Convicted for Manslaughter And Witness Intimidation in Deadly 2016 Trench Collapse

The Suffolk County Superior Court in Boston, Massachusetts, recently sentenced Atlantic Drain Service Company Inc. owner Kevin Otto to two years imprisonment on each of two counts of manslaughter, to run concurrently, and three years of probation for witness intimidation. The court’s action follows a U.S. Department of Labor Occupational Safety and Health Administration investigation into a trench collapse on October 21, 2016, that led to two fatal injuries of two employees.

The Occupational Safety and Health Administration (OSHA), On-Site Consultation Program, offers no-cost and confidential occupational safety and health services to small and medium-sized businesses in all 50 states, the District of Columbia, and several U.S. territories, with priority given to high-hazard worksites. On-Site Consultation services are separate from enforcement and do not result in penalties or citations. Consultants from state agencies or universities, work with employers to identify workplace hazards, provide advice for compliance with OSHA standards, and assist in establishing and improving safety and health programs.

Region 6 - Alliance Renewal Agreement - November 15, 2019

The U.S. Department of Labor’s Occupational Safety and Health Administration Fort Worth and Dallas Area Offices and the National Utility Contractors Association (NUCA) of North Texas continue to recognize the value of maintaining a collaborative relationship to foster safer and more healthful American workplaces. To that end, OSHA and NUCA hereby renew the Alliance signed September 18, 2015, with a continued emphasis on the focus four hazards in the construction industry. Specifically, NUCA and OSHA are committed to providing members and others with information, guidance, and access to training resources that will help them protect the health and safety of workers and understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act). Through the Alliance, the organizations will continue to address the focus four and other hazards observed in the construction industry.
